This website (“Site”) is owned and operated by Martin Janello ("I" or "me"). Your use of the Site constitutes agreement by you to these Terms of Use and all modifications thereof published from time to time on the Site (“Terms”). If you do not agree to the Terms, you may not use the Site. I reserve the right to add to or change the Terms unilaterally and at my sole discretion at any time without notice by including such additions or changes in the posting of the Terms on the Site. You agree to be bound by such additions and changes if you continue to use the Site after the time such additions or changes are made, regardless of whether you previously reviewed them.

 

1. General Informational Nature of Site. This Site is provided for general informational purposes only, and nothing on the Site is intended to be, constitutes, or shall be considered legal advice or other legal assistance. Except for these Terms, nothing on the Site shall be construed as a contract, part of a contract, or offer to contract.

 

2. Confidentiality, Attorney-Client Relationship. Nothing on the Site shall be considered an offer or agreement by me to consider an attorney-client relationship. Communications to me may not be kept confidential unless they occur after I have responded to an inquiry by scheduling in writing a conference to explore the possibility of entering into an attorney-client relationship. Please do not transmit to me any information you would like to keep confidential before that time. Upon my scheduling of a conference, we would enter a stage when communications would be accorded confidentiality subject to the Arizona Rules of Professional Conduct to allow free mutual evaluations whether to enter into a future legal service relationship. However, no attorney-client relationship would be established at this stage. You  acknowledge that this stage would not be deemed to involve legal advice or other legal assistance and that you would not rely on anything I say or do or fail to say or do during this stage. An attorney-client relationship with me can only be established by a prospective client countersigning and delivering a writing entitled Engagement Agreement that has been proposed and previously signed by me. Without limitation, neither the use of the Site, nor any communication by or to me not contained in a fully executed and delivered Engagement Agreement, can create an attorney-client relationship with me.

 

3. Communication Technology. You acknowledge that Internet or mobile phone communications may not be secure. You accept all risks of such uncertainty and authorize the use of Internet and mobile phone connections in our communications.

 

4. License and Practice. I am licensed and practice in Arizona, USA.

 

5. Copyright.  Except for links to third party websites, I claim sole ownership of all content of the Site, including without limitation all text, graphics, designs, and images, and I reserve all rights pertaining thereto. Prospective and existing clients may download and reproduce Site content for their own internal use. However, any other use of Site content, including but not limited to reproduction or republication as a whole or in part, without my express prior written permission is prohibited.

 

6. Prohibited Collection or Use. The collection or use of contact information on the Site for marketing purposes beyond those of the Site is prohibited.

 

7. Links. The Site may provide links to other websites that are exclusively controlled by third parties. These Terms do not cover such sites. You are cautioned to review the terms and conditions of any site you access through a link from the Site.

 

8.  Jurisdiction and Applicable Law. These Terms shall be governed by the laws applicable in the state of Arizona, USA, without giving effect to its conflicts-of-law rules. Exclusive jurisdiction and venue for any claim or dispute involving you and me relating to the Site shall be in the state or federal courts located in the state of Arizona, USA, and you agree to be subject to personal jurisdiction in these courts.

 

9. Miscellaneous. These Terms constitute the entire agreement between you and me regarding your use of the Site and regarding other matters addressed in these Terms. These Terms can only be modified by my posting of revisions of these Terms within the Terms or by a writing signed by me and you specifically referencing these Terms. In the event any part of these Terms is adjudicated by a court of competent jurisdiction to be unenforceable, then such part shall be severed and the remainder shall continue in effect, and the parties authorize and request such court to replace unenforceable provisions by provisions regulating pertinent subject matters as close as lawfully possible to their declared intent.
